Please read the following important terms and conditions before you buy anything on our website and check that they contain everything you want and nothing that you are not willing to agree to.

Your attention is particularly drawn to clause 14 “Limitation of liability”.

These Terms and Conditions (hereinafter, the "Terms and Conditions") regulate the access and use of the Website https://www.joma-sport.com/en_GB/ (the "Website") owned by us, as well as the conditions of the sale of Joma products – clothing and accessories designed for sports and physical activity (“Products”) - through the Website.

In these Terms and Conditions:

"AGUILA" or “we” or “us” means AGUILA SPORT UK LTD, a UK company with registered office at Unit 23 Bury Business Centre, Kay Street, Bury, United Kingdom, BL9 6BU, company registration number 11974358, with VAT number GB335150333; and

User” or “you” means the person using the Website to buy goods from us.

By using the Website or buying goods on our Website, you agree to be bound by these Terms and Conditions, which can be amended from time to time. The Terms and Conditions in force at the time when you use the Website or enter into a contract will be the applicable ones.

If you do not agree with any of these Terms and Conditions, you should stop using the Website immediately.

These Terms and Conditions are only available in English.



2. Use and access to the Website

Any person may use the Website provided that they agree to the Terms and Conditions together with all other policies and principles as set out below.

The sale of the goods on this Website is governed by: (i) these Terms and Conditions; (ii) specific terms and conditions that may be published on the Website (iii applicable laws, industry regulations and standards, codes of practice, including Consumer Rights Act 2015, Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, SI2013/3134, Digital Markets, Competition and Consumers Act 2024.

Access to the Website does not require User’s registration.

Aguila makes no promise that the Website is appropriate or available for use in locations outside of the UK. If you choose to access the Website from locations outside of the UK, you acknowledge that you do so at you own initiative and are responsible for compliance with local laws where they apply.



3. User’s Personal Data

In order to purchase the products offered through the Website, you may choose between:

- Pre-registration: you may register by completing the form available on the Website. The required data (name, surname, e-mail address, telephone number) are requested in order to process orders and keep you informed about the order process. Any personal information that you provide to us will be dealt with in line with our Privacy Policy available at https://www.joma-sport.com/en_GB/privacypolicy.html You are responsible for making sure that your password and any other account details are kept secure and confidential.

- Purchase without registration: You can make a purchase without previous registration. During the purchase process, you will be required to provide us billing and shipping information necessary to send the order.

It is your responsibility to verify that your details are correct and complete and inform us when there is any variation and / or modification in the information provided in the purchase process.



4. Use of the Website

The User is permitted to use the Website only for personal, non-commercial purposes and primarily for purchase of the goods on the Website. Use of the Website in any other way, including any unacceptable use set out below, is not permitted.

As a condition of the use of the Website, you agree not use the Website to commit any act of fraud or criminal offenses or for any purpose that is unlawful under any applicable law.

You agree not to send, use or reuse illegal, offensive, abusive, indecent, defamatory, obscene or threatening material of any kind, or that involves a violation of copyright, trademarks or confidentiality, privacy or any other right, or is otherwise harmful or objectionable to third parties, or whose content contains computer viruses, political propaganda, advertising content, chain letters, mass mailings or any other type of "spam" and, in general, any kind of nuisance or unnecessary inconvenience.

Likewise, you undertake not to maliciously or intentionally cause damage or harm that may impair, alter the Website itself and not to introduce or spread computer viruses, or malware or other similar harmful software code that may cause unauthorized alterations of the contents or systems of the Website.

You also agree not use the Website to simulate communications from Aquila or another service or entity in order to collect identity information, authentication credentials, or other information (‘phishing’); in any manner that disrupts the operation of our Website or business or the website or business of any other entity; in any manner that harms minors; to promote any unlawful activity (including but not limited to the promotion or sale of any unlawful goods or services); to represent or suggest that we endorse any other business, product or service unless we have separately agreed to do so in writing; to gain unauthorised access to or use of computers, data, systems, accounts or networks; or to attempt to circumvent password or user authentication methods.

In the event that the User breaches these Terms and Conditions, Aguila may terminate or suspend the User’s use of the Website, including all those Users who have benefited directly or indirectly from such actions, and take any action Aguila considers necessary to remedy the breach. In this sense, Aguila declares that it has enabled the appropriate mechanisms to detect any possible fraudulent, anomalous or fraudulent action that seeks to alter the general conditions of use of the account by Users.



5. Ordering goods

Below, we set out how a legally binding contract between the User and us is made.

To place an order on the site you should follow the online shopping process and click on the ‘Confirm Purchase’ button. You will be able to correct any errors before submitting order to us. We will acknowledge it by email. This acknowledgement does not, however, mean that the order has been accepted by us.

We may contact you to say that we do not accept the order. This is typically for the following reasons:

-         the goods are unavailable;

-         we cannot authorise your payment;

-         you have ordered too many goods; or

-         there has been a mistake on the pricing or description of the goods.

We will only accept the order when we email you to confirm this (Confirmation Email). At this point:

-         a legally binding contract will be in place between you and us; and

-         we will dispatch the goods to you.

If you are under the age of 18 you may buy any goods from the Website. You may not be able to buy certain goods because you are too young. These are set out on the relevant webpage for the goods.

In no event shall Aguila intentionally offer for sale more units than it has available. In the event that the product is not available after the order has been placed, you will be informed by email or telephone, offering the possibility to delay delivery or replace the product with a similar one, or otherwise refund the amount paid.



6. Prices and payment method

We accept the following payment methods: credit and debit cards (Visa, Mastercard) and PayPal. We do not accept cash or cheques.

We will do all that we reasonably can to ensure that all of the information you give us when paying for the goods is secure by using an encrypted secure payment mechanism. However, in the absence of negligence on our part, any failure by us to comply with this contract or our Privacy Policy (see clause 4) or breach by us of our duties under applicable laws, we will not be legally responsible to you for any loss that you may suffer if a third party gains unauthorised access to any information that you give us.

All payments by credit card or debit card need to be authorised by the relevant card issuer.

If your payment is not received by us and you have already received the Products, you must:

-         pay for such Products as soon as possible and in any case within 30 days; or

-         return them to us as soon as possible and in any case within 30 days. If so, you must keep the Products in your possession, take reasonable care of them (including ensuring that you follow any instructions or manuals given with the goods) and not use them before you return them to us.

If you do not pay for the goods and fail to return them in accordance with clause, we may collect the goods from you at your expense. We will try to contact you to let you know if we intend to do this.

Nothing in this clause affects your legal rights to cancel the contract during the cancellation period as set out in clause 10.2.

The prices of the Products listed on the Web may be subject to change. Aguila reserves the right to change prices without notice.

If we identify a clear error in the price of the Products, we will inform you and you will have an option to reconfirm your order at the correct price or, failing that, cancel it. If we are unable to contact you, the order will be treated as cancelled.

Notwithstanding the above mentioned, Aquila may cancel an order even if the price of the Product has already been paid, when there has been an obvious error in the price of the Product and you knew or ought to have known about the error. In that case, you will be refunded the corresponding price in the same form of payment in which the order was placed.

Also, the User must notify Aguila of any undue or fraudulent charge on the card used for purchases, through the "contact" section of the Website, or by sending an email to email address provided in these Terms and Conditions, as soon as possible to enable Aguila to make appropriate arrangements.



7. Information about JOMA's Products

You have certain legal rights in relation to the nature of goods (also known as ‘statutory rights’). The goods that we provide to you must be as described, fit for purpose and of satisfactory quality.

We are under a legal duty to supply you with goods that are in conformity with this contract.

The packaging of the goods may be different from that shown on the site.

While we try to make sure that:

-         all weights, sizes and measurements set out on the site are as accurate as possible, there may be a small tolerance in such weights, sizes and measurements; and

-         the colours of our goods are displayed accurately on the site, the actual colours that you see on your device may vary depending on the device that you use.

 

8. Delivery times, place of delivery and losses

8.1. Product Delivery

We will deliver the Product at the address provided by you when you placed an order. To ensure the efficient delivery of the order, you are kindly requested to provide an address where the order can be delivered during standard business hours.

Aguila delivers Products from Monday to Friday. Aguila will not make deliveries or shipments on Saturdays and Sundays or bank holidays.

To avoid delivery issues—such as incorrect address details or unsuccessful attempts due to the recipient's absence—it is essential that the relevant form is completed accurately. This includes the mandatory provision of a contact telephone number, preferably a mobile number, to facilitate communication and ensure successful delivery.

Aguila shall not be held liable for any errors or failures in the delivery of goods resulting from an inaccurate, false, or incomplete delivery address provided by you in the order form.

We do not make deliveries to addresses outside of the UK.

8.2. Delivery timeframe

Orders placed via the Website are typically prepared within 24 to 48 hours, depending on the time they are received by Aquila's systems. In addition to the preparation period, please allow for delivery time indicated below, which varies based on the delivery address provided in the order.

We offer two types of delivery:

1.     Standard shipping - delivery within 2 to 5 working days; and

2.     Express shipping – delivery within 24 to 48 hours.

Available delivery options and costs will be provided to you during the online checkout process.

Please note that all delivery timeframes are approximate and should be considered estimates only. While we strive to meet these timelines, actual delivery dates may vary due to factors beyond our control.

The estimated date for delivery of the goods is set out in the Confirmation Email.

If something happens which is outside of our control and affects the estimated date, we will provide you with the revised estimated date of delivery.

It will not be possible to send orders to P.O. Boxes.

We will try to deliver Products in a single shipment whenever possible. We may deliver Products in instalments. In this case we will notify you by sending an email to the email address provided by you when placing the order. In this case we will not charge any additional shipping costs.

You are responsible for the Products once they have been delivered to the address specified by you when you placed your order with us. In other words, the risk in the Products passes to you when you, or a third party nominated by you, takes possession of the Products.

8.3. Delivery diligence

Upon receipt of the Product, you are required to inspect the condition of the package in the presence of the courier. To support any potential claims against the courier company, we strongly recommend capturing photographic evidence of any visible damage or irregularities.

If you observe any issues with the Product, these must be clearly recorded on the delivery receipt and reported to us without delay via email at the email address specified in these Terms and Conditions.

Aguila informs the User that the courier company has obtained insurance to cover potential risks of loss or damage to the Product.

8.4. Delivery costs

  • Standard Shipping: £4
  • Free Standard Shipping: Available on orders over £50
  • Express Shipping: £12


9. Faulty products, returns and cancellation rights

9.1. Faulty products

Summary of some of your key rights:

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 say that up to 14 days after receiving your goods, in most cases, you can change your mind and get a full refund.

The Consumer Rights Act 2015 says goods must be as described, fit for purpose and of satisfactory quality. During the expected lifespan of your product you’re entitled to the following:

  • up to 30 days: if your goods are faulty, you can get a refund;
  • up to six months: if it can’t be repaired or replaced, then you’re entitled to a full refund in most cases;
  • up to six years: if the goods do not last a reasonable length of time, you may be entitled to some money back.

Nothing in this contract affects your legal rights if the goods are faulty. You may also have other rights in law.

If your goods are faulty, please contact us provided in these Terms and Conditions.

9.2. Cancellation, Exchanges or Returns:

You have the right to cancel a contract within 14 days without giving any reason. However, for some goods you do not have the right to cancel or you may lose the right to cancel in certain circumstances. This is further explained below.

The cancellation period will expire after 14 days from the day on which you acquire, or a third party other than the carrier and indicated by you acquires, physical possession of the Products.

To be eligible for return, the Product must meet the following conditions:

  • Unused and Unwashed: Products must not have been used or washed. You may try on clothing and footwear, but not for sports or any activity beyond fitting.
  • Original Packaging: The Product must be returned in its original packaging and in good condition. Packaging that is opened, torn, or otherwise damaged will be considered unacceptable.
  • Intact Labels: All original labels must remain attached and untampered with.
  • Complete Items: The Product must be returned in full. For example, both items of a pair must be included.

You do not have the right to cancel in respect of the following goods and will not be entitled to a refund unless such goods are faulty:

-         goods that are made to your specifications or which are clearly personalised; and

-         goods received sealed for health protection or hygiene reasons (eg underwear, swimwear, socks), once you remove or break the seal.

Return Procedure

If you wish to return a Product, you must initiate the process via your account by navigating to "Profile" > "My Orders" and selecting the "Request Return" option.

Once the return request has been submitted, you will receive a return form by email, which must be completed and included in the shipment.

Please note that:

  • Shipping costs for the return are the responsibility of the User.
  • The Product must be sent using a courier service of your choice, in accordance with the conditions outlined in these Terms and Conditions.
  • Returns should be addressed to: Aguila Sport UK Ltd, Unit 23, Bury Business Centre, Kay Street Bury, BL9 6BU.

Effects of cancellation

If you cancel the contract, we will reimburse to you all payments received from you, including the costs of delivery (except for the supplementary costs arising if you chose a type of delivery other than the least expensive type of standard delivery offered by us).

We will make the reimbursement without undue delay, and not later than:

- 14 days after the day we received back from you any goods supplied; or

- (if earlier) 14 days after the day you provide evidence that you have returned the goods; or

- if there were no goods supplied, 14 days after the day on which we are informed about your decision to cancel the contract.

We will make the reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.

If you have received the Products, you shall send back the Products without undue delay and in any event not later than 14 days from the day on which you communicate your cancellation from this contract to us. The deadline is met if you send back the goods before the period of 14 days has expired.



10. Conditions applicable to promotional codes

When used in accordance with its terms and conditions, promotional codes provide a single discount on either one Product or an entire order containing multiple Products, valid only during the specified promotional period.

Promotional codes are personal and non-transferable, and may only be used for online purchases through the Website. Users may not sell, exchange or transfer promotional codes to others. It is strictly prohibited to share promotional codes publicly, including via websites or other platforms offering gifts, sales, or exchanges.

Promotional codes may not be used for commercial purposes.

Promotional codes are linked exclusively to the JOMA brand. They may not be used in connection with any other brand, company (other than Aguila), or name, nor in any illegal, improper, or disrespectful manner that could harm JOMA’s and Aguila’s reputation.

Each promotional code may be used once, for a single order, and cannot be combined with other promotional codes, offers, or discounts.

Promotional codes cannot be exchanged for cash.

Aguila reserves the right to cancel any promotional code immediately if it suspects misuse or violation of these conditions, or if the code is used in any inappropriate manner, at its sole discretion.

Certain Products are excluded from promotional offers, such as: official team, federation and committee jerseys and official racing or club shoes.



11. Intellectual property rights

The intellectual property rights in the Website and in any text, images, photographs, video, audio or other content, design, software and source code of this Website or other information or material submitted to or accessible from the Website (Content) are owned by us and our licensors.

We and our licensors reserve all our intellectual property rights (including, but not limited to, all copyright, trademarks, domain names, design rights, database rights, patents and all other intellectual property rights of any kind) whether registered or unregistered anywhere in the world. This means, for example, that we remain owners of them and are free to use them as we see fit.

Nothing in these Terms and Conditions grants you any legal rights in the Website or the Content other than as necessary for you to access it. You agree not to adjust, try to circumvent or delete any notices contained on the Website or the Content (including any intellectual property notices) and in particular, in any digital rights or other security technology embedded or contained within the Website or the Content.

The reproduction, transmission, adaptation, translation, distribution, public communication, including making content available by any means or in any form—in whole or in part—is expressly prohibited, regardless of the technical method used.

Use by you of any trademarks on the Website or in the Content is strictly prohibited unless you have our prior written permission.



12. Limitation of liability

Except for any legal responsibility that we cannot exclude in law (such as for death or personal injury) or arising under applicable laws relating to the protection of your personal information, we are not legally responsible for any:

-         losses that were not foreseeable to you and us when the contract was formed;

-         losses that were not caused by any breach on our part;

-         business losses; or

-         losses to non-consumers.

 We are not liable to you if we fail to comply with these Terms and Conditions because of circumstances beyond our reasonable control.

Aquila is committed to resolving any issues that may arise and will provide all necessary support to ensure a prompt and satisfactory resolution for the User.

Except for any legal responsibility that we cannot exclude or restrict in law, our liability for any claim shall be limited to the reimbursement of the amount paid by you for the purchase of the Product or the contracted service.



13. Suggestions, comments, complaints

You are welcome to submit suggestions and comments, provided that the content is lawful and appropriate. Submissions must not be:

  • Unlawful, obscene, abusive, threatening, defamatory, or false
  • Invasive of others’ privacy or infringing on intellectual property rights
  • Harmful, offensive, or otherwise objectionable to third parties
  • Containing viruses, political propaganda, advertising, chain letters, mass mailings, or any form of spam

14. Variation

The information presented on this Website is current as of the date of its last update. Aguila reserves the right to update, modify, or remove any content on the Website at its discretion.

No changes to these Terms and Conditions are valid or have any effect unless agreed by us in writing or made in accordance with this clause.

We reserve the right to vary these Terms and Conditions from time to time. Our updated Terms and Conditions will be displayed on the Website and by continuing to use and access the Website following such changes, you agree to be bound by any variation made by us. It is your responsibility to check these Terms and Conditions from time to time to verify such variations.



15. Severance

If any provision of these Terms and Conditions (or any part of a provision) is found to be illegal, invalid, or unenforceable by a court or other competent authority, that provision or part-provision shall, to the extent required, be deemed severed from these Terms and Conditions and rendered ineffective as far as possible without affecting the validity or enforceability of the remaining provisions.

The legality, validity, and enforceability of the remaining provisions of these Terms and Conditions shall not be affected or impaired in any way by the severance of any provision or part-provision under this clause.



16. Third party rights

No one other than a party to this contract has any right to enforce any term of this contract.



17. Applicable Law and Jurisdiction

The laws of England and Wales apply to these Terms and Conditions. 

Any disputes will be subject to the non-exclusive jurisdiction of the courts of England and Wales. This means that you can choose whether to bring a claim in the courts of England and Wales or in the courts of another part of the UK in which you live.
